1. The agreement
These Terms of Service (“Terms”) govern your use of the Framiq website at www.framiq.app, the signed-in app there, and the Framiq Launch Videos GitHub App (together, the “Service”). “Framiq,” “we” and “us” mean the provider of the Service. Our Privacy Policy explains how we handle information and is part of these Terms. If you use the Service for a company or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.
2. Who can use Framiq
You must be at least 18 years old and able to form a binding contract. You need a GitHub account to use the Service.
3. What the Service does
Framiq makes marketing videos of web apps built with React or Next.js. You sign in with GitHub, choose your app’s repository (and, if you like, your website’s address for your current logo and brand), and write a short brief about what to feature. The Service uses automated systems, including AI, to read your code, show your product’s real screens with sample data it writes itself, and add generated music, voiceover and sound effects. You then watch and download the finished videos.
Each run makes one video in the style, voice and music you choose. We may change, add or remove features as the Service develops.
4. Your GitHub account and repository access
- You choose which repositories Framiq can read when you install the GitHub App, and you can change or remove that access in GitHub at any time. Only connect repositories you have the right to share with us for this purpose, including under any agreement with your employer or clients.
- Framiq’s access is read-only. The Service copies your repository to a single-use, isolated cloud machine for each run, and never commits, pushes, opens pull requests or otherwise changes your repositories. The machine is discarded when the run ends.
- To show your real screens, the Service installs your app’s dependencies and runs parts of your app’s code on that machine. Do not connect repositories that contain malicious code, and do not store passwords, keys or real customer records in repositories you connect.
- Keep your GitHub account secure. You are responsible for activity in the Service under your account.
5. Your code and content
You keep all rights to your code, your website, your brief and anything else you give the Service (“Your Content”). You give Framiq permission to access, copy, process and transmit Your Content only as needed to make your videos and provide the Service to you, including through the service providers described in the Privacy Policy.
Your code is used only to make your videos. It is not used to train AI models. You are responsible for Your Content and for having the rights needed to use it this way, including for logos, fonts, images and other material in your product that may appear in your videos.
6. Your videos
As between you and Framiq, you own the videos the Service makes for you. To the extent Framiq has any rights in them, we assign those rights to you. You may use your videos for any lawful purpose, including commercial marketing, advertising, social media, your website, product announcements and sales.
We will not use your videos to promote Framiq without your permission.
Material from Your Content that appears in your videos, such as your logo, fonts and screens, stays subject to whatever rights and licenses already apply to it. Because videos are generated automatically, another customer may receive a video with similar music, voices, wording or visual style.
7. Review your videos before you use them
Videos are made by automated systems, including AI, and can contain mistakes: a screen shown in the wrong state, a caption or voiceover line that is inaccurate, or a feature described differently from how it works. Names, numbers and other data on screen are fictional samples, not your real data. Watch every video before you publish it. You are responsible for the videos you choose to publish and for the claims they make about your product.
8. Runs, downloads and storage
A run can fail or stop before it finishes, for example when a repository is not a React or Next.js web app or cannot be set up automatically. Videos and other run files are deleted automatically 30 days after the run, so download any video you want to keep. The Service is not a backup or storage service.
9. Fees, plans and payment
Your first video is free and needs no payment details. After that, each video uses one video from your balance: the videos included in a monthly plan, then any videos you bought in a video pack. Prices are shown on our pricing page and before you pay.
Plans are billed monthly in advance and renew automatically until you cancel. A plan's videos are available for the month they were billed for and do not roll over. Video pack videos do not expire. You can change or cancel your plan at any time from the billing page; a cancellation takes effect at the end of the month you already paid for, and you keep your plan's videos until then. Payments are processed by Stripe, and Framiq does not store your card number.
If a run ends without producing a video, the video it used is returned to your balance automatically, up to two times in any 30 days; a plan video is returned only within the billing month it belongs to. If you think a run failed on our side beyond that, write to us and we will review it. Except where the law requires otherwise, payments are not refundable. We may change prices with notice; a new price applies from your next billing month after the notice, and you can cancel before then.
10. Acceptable use
You agree not to, and not to help anyone else:
- connect repositories or use content you do not have the right to use, or make videos that infringe anyone’s intellectual property or other rights;
- use the Service to make videos that are false or misleading, unlawful, or that impersonate another person or business;
- use the Service to run malicious code, mine cryptocurrency, attack or probe our systems or anyone else’s, try to break out of a run machine, or access another customer’s data;
- get around the Service’s limits or security, or access it through automated means other than the ones we provide;
- copy, reverse engineer or resell the Service, except where the law does not allow this restriction, or use it to build a competing product; or
- use the Service in violation of any law or of GitHub’s terms.
11. Our property
The Service, including its software, design and the Framiq name and logo, belongs to Framiq or its licensors. We give you a limited, non-exclusive, non-transferable and revocable license to use the Service while you follow these Terms. If you send us feedback or suggestions, we may use them without any obligation to you.
12. Third-party services
The Service depends on third-party services, including GitHub and the providers listed in the Privacy Policy. GitHub’s own terms govern your GitHub account. We are not responsible for services we do not control.
13. Ending your use
You can stop using the Service at any time: sign out, uninstall the GitHub App, and ask us to delete your information as described in the Privacy Policy. We may suspend or end your access if you break these Terms, if your use creates legal or security risk, or if we stop offering the Service, and we will tell you when we reasonably can. Sections that by their nature should continue after your use ends will continue, including sections 5, 6 and 14 to 17.
14. Disclaimers
The Service and all videos are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will make a video from every repository, that videos will be accurate or error-free, or that the Service will be uninterrupted or secure.
15. Limitation of liability
To the maximum extent permitted by law, Framiq will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from the Service or these Terms. Framiq’s total liability for all claims about the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim arose or one hundred U.S. dollars ($100).
Some places do not allow these exclusions or limits, so some of them may not apply to you.
16. Indemnity
You will defend and indemnify Framiq against claims, losses and expenses, including reasonable legal fees, that arise from Your Content, from how you use your videos, or from your breach of these Terms or the law.
17. Disputes
If you have a concern about the Service, please contact us first at [email protected]. Before starting any formal claim, you and Framiq agree to try to resolve the dispute informally for at least 30 days.
18. Changes to these Terms
We may update these Terms as the Service changes. We will change the date at the top of this page, and if a change is material we will give notice in the Service before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
19. General
These Terms and the Privacy Policy are the entire agreement between you and Framiq about the Service. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of the Service. These Terms do not create a partnership, agency or employment relationship.
